This software is an Alpha version of SIMUVERSE. Bugs, crashes, or other defects may occur and can usually be resolved by restarting the application. For users on Mobile VR platforms, it is advised to play SIMUVERSE Alpha 1 with a fully charged battery.

End-User License Agreement for SIMUVERSE Alpha 1

This End-User License Agreement (EULA) is a legal agreement between you (either an individual or a single entity) and the mentioned author (Virtualworld Systems LLC, LLC or its successors) of this Software for the SIMUVERSE Alpha 1 identified above, which includes computer software and may include associated media, printed materials, and "online" or electronic documentation (SIMUVERSE Alpha 1).

By installing, possessing, or otherwise using the SIMUVERSE Alpha 1 software and webapp, you agree to be bound by the terms of this EULA. By accepting this EULA, you represent that you are lawfully able to enter into this EULA and, if you are entering into this EULA for a company or other entity, that you have legal authority to do so and to bind the entity to the terms set forth herein.

SIMUVERSE Viewer and WebApp

The SIMUVERSE Viewer refers to the game client associated with SIMUVERSE. Additionally, there is a web app accessible at simuverse.co, offering users an alternative way to configure public worlds, events, scenes, custom avatars, etc. that can become a part of the content in SIMUVERSE.

1. Acceptance of Terms

By accessing or using SIMUVERSE, including its website www.simuverse.co and associated services provided by Virtualworld Systems LLC, you agree to comply with and be bound by these comprehensive Terms of Service (TOS). If you do not agree to these terms, please refrain from using the platform.

2. Registration and Account Security

To use certain features of SIMUVERSE, you may be required to register for an account. You are responsible for maintaining the confidentiality of your account information and are fully responsible for all activities that occur under your account. You agree to notify SIMUVERSE immediately of any unauthorized use or security breaches.

3. Refunds and Chargebacks

As a general rule, SIMUVERSE does not provide refunds on ticket sales. However, in exceptional cases where users believe they have a legitimate reason for a refund, they must initiate the refund request by emailing support@simuverse.co before considering a chargeback.

Users are strictly prohibited from initiating chargebacks without prior communication with SIMUVERSE. Failure to adhere to this policy may result in additional fees being charged to the user, as well as potential account suspension or banning. It is essential to contact us directly to address any concerns or issues related to ticket purchases.

4. Content Ownership and Usage

SIMUVERSE allows users to upload scenes, avatars, and other content via the provided Unity SDK. Users retain ownership of their uploaded content but agree to allow public access when making scenes or avatars public.

5. Commercial Accounts and Ticket Sales

Commercial account holders must work with SIMUVERSE's community manager to set event prices. Ticket sales are subject to a 20% commission by SIMUVERSE, with 80% going to the account holder. Cashouts are available 30 days after the event, minus transaction fees charged by Stripe.

6. User Conduct

Users agree to treat others with respect and refrain from harassment. SIMUVERSE reserves the right to ban users, devices, IP addresses, or specific accounts for violations of community guidelines.

7. Platform Rights

SIMUVERSE retains all rights to its viewer softwares and webapps that are part of its systems. Users retain rights to their content but agree to share it according to platform settings. Avatars can be marked as private, limiting access to the user only. SIMUVERSE and Virtualworld Systems LLC are not liable for any damages or losses resulting from platform use. Users accept any risks associated with participation in the platform. The entire risk arising out of use or performance of SIMUVERSE remains with the user. SIMUVERSE does not warrant that the platform will meet user requirements, be uninterrupted, or error-free.

8. Additional Guidelines for Event Hosting

You can't sell tickets to events hosted on our platform outside of our ticketing system. Free/pro users do not have access to our internal ticketing for events system; that is reserved for commercial accounts. Contact us via email to set up a meeting to discuss the process and sign an agreement if you want to SELL TICKETS to events on our platform.

Free events can be created by PRO/PREMIUM users. Free users only get the ability to upload 1 scene and make it a 'public world.' Pro/premium users get 5 scene upload slots, the ability to create up to 10 free events with scenes they have on file at the time of each, up to 10 events per month. Each of their 5 upload slots can also be turned into public worlds additionally.

9. Content Uploading Guidelines

Users are solely responsible for the content they upload to SIMUVERSE. By uploading content, including avatars, scenes, video/audio materials, names, and brandings, users affirm that they have the legal right, permission, or appropriate licenses to publicly showcase such content on the SIMUVERSE platform.

Prohibited content includes, but is not limited to, copyrighted materials without proper authorization, explicit or offensive content, and any content that infringes upon the intellectual property rights of others.

SIMUVERSE reserves the right to remove, restrict access to, or take any necessary action regarding content that violates these guidelines. Users uploading such content may face penalties, including but not limited to account suspension or banning.

10.1 Adult Only Content Access

In order to access SIMUVERSE regions or listings designated as "Adult Only" Content, which may include explicitly sexual, intensely violent, or otherwise Adult-designated content, you affirm that you are at least eighteen (18) years of age or the age of legal majority in your jurisdiction, whichever is higher. You further agree to submit to account verification as required by SIMUVERSE, providing true and accurate identification documentation to verify your age. Compliance with SIMUVERSE Maturity Ratings is required, and activities defined as "Adult Only" must be conducted within regions designated as such.

10.2 Adult Content Policy

Users are allowed to create adult content-related scenes, worlds, events, or avatars, but such content is restricted to private worlds only. It is the user's responsibility to ensure that their adult content complies with all applicable laws in the United States, the State of Wyoming, and the user's own country or state. SIMUVERSE prohibits the creation or sharing of adult content that violates any legal standards.

Any violation of this policy may result in the removal of the content, as well as potential account suspension or banning. Users are encouraged to familiarize themselves with local laws and regulations regarding adult content and ensure their compliance within SIMUVERSE.

11. Changes to Terms

SIMUVERSE reserves the right to modify these terms at any time. Users will be notified of changes, and continued use implies acceptance of the updated terms.

Privacy Policy for SIMUVERSE

6. Data Retention

SIMUVERSE retains user information as long as necessary for the purposes outlined in this privacy policy or as required by law.

7. Children's Privacy

SIMUVERSE is not intended for children under the age of 13. If a parent or guardian becomes aware that their child has provided personal information without their consent, they should contact SIMUVERSE to request deletion of the information.

8. Governing Law

Any dispute related to the SIMUVERSE privacy policy is subject to the laws of the State of Wyoming.

9. Consent to Processing

By using SIMUVERSE, users consent to the processing of their information as outlined in this privacy policy.

10. Changes to Privacy Policy

SIMUVERSE may update its privacy policy to reflect changes in data practices. Users will be notified of significant changes, and continued use implies acceptance of the updated policy.
